1. Acceptance of Terms

By accessing and using Shashin! by FrontHAUS Pte. Ltd. ("the Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms constitute a legally binding agreement between you and FrontHAUS Pte. Ltd., a company incorporated under the laws of Singapore. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Shashin! is an AI-powered photobooth platform that provides:

Photo and video capture capabilities
AI-powered image generation and editing with selectable themes
AI video generation from processed photos (tier-dependent)
Kiosk mode for events and professional photography
Cloud storage and session management
Subscription-based feature access with tiered quotas
Credit-based AI photo generation (5 credits per photo, 25 credits per video)
Public photo sharing via unique links and ZIP download
Session branding and custom frame overlays
Live chat and support ticket system
Knowledge base and help centre
Newsletter and email communications
Customer satisfaction surveys

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You must be at least 18 years of age to create an account.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Deletion

You may request deletion of your account at any time. Upon requesting deletion, your account will enter a 30-day grace period during which you may cancel the deletion request. After the grace period, your account and associated data will be permanently deleted in accordance with our Data Retention Policy.

3.4 Session Management

You may view and manage active login sessions associated with your account. You have the ability to revoke individual sessions or all sessions at any time.

4. Subscription Plans

4.1 Plan Types

We offer multiple subscription tiers (Trial, Basic, Pro, and Enterprise) with different features, quotas, and credit allocations. Plan details, including pricing, are available on our pricing page and may be updated from time to time with prior notice.

4.2 Billing

Subscription fees are billed in advance on a monthly basis through our payment processor, Stripe. All fees are in USD and are non-refundable except as required by applicable law, including the laws of Singapore.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. Scheduled downgrades will take effect at the beginning of your next billing period.

4.4 Credits

The Service uses a credit-based system for AI content generation. Each AI photo generation consumes 5 credits and each AI video generation consumes 25 credits. Credits are allocated with your subscription plan and may also be purchased separately as credit packages. Credits expire one (1) year from the date of purchase or allocation. Credits are deducted on a first-in, first-out (FIFO) basis. Unused credits are non-refundable and non-transferable. Video generation is available only on Pro and Enterprise tiers, subject to monthly limits (Pro: 50 videos/month, Enterprise: unlimited).

5. User Content

5.1 Your Rights

You retain all rights to photos, videos, and other content you upload or create using the Service ("User Content").

5.2 License to Us

By uploading User Content, you grant us a limited, worldwide, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service.

5.3 Content Restrictions

You agree not to upload or create content that:

Violates any law or regulation
Infringes on intellectual property rights
Contains malware or harmful code
Is defamatory, obscene, or offensive
Violates privacy or publicity rights

6. AI Features and Data Processing

Our Service uses AI-powered image processing to generate stylised photos based on selected themes, and AI-powered video generation to create animated videos from processed photos. By using these features, you consent to your photos and videos being processed by our AI systems. AI-generated content (including both photos and videos) is provided "as is" and we make no warranties about the output quality, accuracy, or suitability for any particular purpose. Each AI photo generation consumes 5 credits and each AI video generation consumes 25 credits from your account balance. Processing is subject to rate limits based on your subscription tier. Video generation is only available on eligible subscription tiers.

IMPORTANT: AI-GENERATED CONTENT (INCLUDING PHOTOS AND VIDEOS) IS INHERENTLY UNPREDICTABLE. OUTPUTS MAY CONTAIN VISUAL ARTEFACTS, DISTORTIONS, INACCURACIES, OR RESULTS THAT DO NOT MEET YOUR EXPECTATIONS OR AESTHETIC PREFERENCES. THIS IS A KNOWN AND ACCEPTED CHARACTERISTIC OF AI IMAGE AND VIDEO GENERATION TECHNOLOGY.

6.1 Credit Consumption

Credits are consumed at the time an AI generation request is submitted and processing begins (5 credits per photo generation, 25 credits per video generation). Credits are non-refundable once successfully consumed, regardless of the output quality, visual appearance, aesthetic result, or whether the generated content meets your expectations. You acknowledge that:

AI outputs may vary in quality and may not always produce visually pleasing or accurate results
Credits are deducted for each generation attempt, including those that produce unsatisfactory, distorted, or unexpected results
No refunds, credits, or compensation of any kind will be issued for AI-generated content that does not meet your subjective expectations

6.2 Automatic Credit Refunds

If an AI photo or video generation fails to complete due to a system error, server unavailability, processing timeout, or other technical failure on our end, the credits consumed for that request will be automatically refunded to your account. Automatic credit refunds also apply in the following circumstances:

A generation job fails due to a server error, processing timeout, or infrastructure issue before producing a completed result
A generation job is cancelled by you or by an administrator before it completes
No processing server is available to handle your request at the time of submission

Refunded credits are returned to your account as a new credit grant and are available for immediate use. Refunded credits are not subject to the expiry date of the original transaction from which they were deducted. Automatic refunds apply only to credits consumed for generation requests that did not produce a completed result; credits are not refunded for successfully completed generations regardless of output quality.

Note: When a failed or cancelled generation is retried by an administrator, new credits will be deducted for the retry attempt. The previously refunded credits remain in your account.

6.3 No Guarantee of Output

FrontHAUS Pte. Ltd. does not guarantee that AI-generated content will be free of errors, bugs, visual artefacts, or defects. AI models and workflows are continuously evolving, and results may differ between sessions or theme versions. By using the AI features, you accept full responsibility for evaluating the suitability of any generated content before use, distribution, or publication.

7. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Use automated means to access the Service without permission
Resell or redistribute the Service without authorization

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by FrontHAUS Pte. Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Privacy

Your use of the Service is also governed by our Privacy Policy.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF THE REPUBLIC OF SINGAPORE, FRONTHAUS PTE. LTD., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, FRONTHAUS PTE. LTD. ASSUMES NO LIABILITY OR RESPONSIBILITY FOR: (A) ANY ERRORS, MISTAKES, OR INACCURACIES IN AI-GENERATED CONTENT; (B) ANY PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE; (C) ANY UNAUTHORISED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; (D) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (E) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE SERVICE BY ANY THIRD PARTY; (F) ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; OR (G) ANY ACTIONS OR OMISSIONS OF THIRD-PARTY SERVICE PROVIDERS, INCLUDING BUT NOT LIMITED TO PAYMENT PROCESSORS, CLOUD STORAGE PROVIDERS, AND AI PROCESSING INFRASTRUCTURE.

You expressly acknowledge and agree that FrontHAUS Pte. Ltd. shall have no liability whatsoever arising out of or in connection with your use of the Service. Your use of the Service is entirely at your own risk. Where any jurisdiction does not allow a complete exclusion of liability, our liability shall be limited to the minimum extent permitted by the applicable law of that jurisdiction.

11. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, PHOTO PROCESSING, VIDEO GENERATION, THEME OUTPUTS, AND RELATED FEATURES, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. FRONTHAUS PTE. LTD. MAKES NO WARRANTY THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) AI-GENERATED CONTENT WILL BE ACCURATE, AESTHETICALLY PLEASING, FREE OF ARTEFACTS, OR SUITABLE FOR ANY PARTICULAR USE; (C) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (D) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED; OR (E) CREDITS CONSUMED DURING PROCESSING WILL PRODUCE SATISFACTORY RESULTS.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore. We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore, the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA) in our handling of personal data where applicable.

15. Indemnification

You agree to indemnify, defend, and hold harmless FrontHAUS Pte. Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or telecommunications failures, power outages, or failures of third-party service providers.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Fair Use Policy, and Data Retention Policy, constitute the entire agreement between you and FrontHAUS Pte. Ltd. regarding the use of the Service, and supersede all prior agreements, understandings, and representations.
